Hi Nigel,
4 years has elapsed and according to the contract the developer is now oblidged to supply deeds in exchange for a sum of money as stated in the contract. I have emailed and telephoned the developer who has not responded. It may be the deeds are not ready due to government bureaucracy or because he has not done the relevant paperwork. Is there anything I can do without lawyers to find out where the fault lies in order to get my deeds.
We have no mortgage and at the time of purchase the land on which it sat was mortgaged free. _________________ ferret |

Nigel,
I have today received a telephone call from our developer. He told me the documents for our property are complete and were submitted to the Land Registry Office 2 years ago. He claims that any delay is with them as they are behind.
Do you know if this possible or likely, and are they likely to entertain enquiries on this from us, in writing or if we turn up on their door in order to confirm the developer statement. _________________ ferret |

Hi ferret,
Your developer could well be telling the truth. Currently, there are some 130,000 properties without Title Deeds and the average time it takes for them to be issued is around 12 years.

You may be able to get more information from the Land Registry, but it's pointless writing to them as in my experience they don't have the common courtesy to reply.
If you do visit, take your contract of sale and any other documents you may have regarding your purchase - and take someone who is fluent in Greek with you.

Nigel,
Just an update,---I have had a letter delivered to me in the UK from my developer's lawyer. It confirms all papers were submitted in March 2007. I am also told by a neighbour that officials from the Land Registry were all over our properties measuring up, yesterday. It will be interesting to see how long it all takes and what further mines explode under our feet.

Ferret,
You could do what a friend of mine did in a similar situation. He asked the developer to give him a legally enforceable document that clearly states that the title deeds are held up in the Land Registry Office, for purely administrative reasons, but he, the developer, confirms that there are no enbumerances on the land and I, the developer, relinquish full title to the land in favour of you the purchaser. A copy to this effect has also been sent to the Land Registry Office.
No response was received from the developer concerned proving he was lying. A personal trip to the Land Registry will also confirm the reason for the delay. |

I expect they were checking it out to issue the Certificate of Final Completion - or measuring up for the sub-division of the land into individual plots.
